Apple: Calls for the cessation of sales of the following major products.

Samsung: He argues that their designs are original and technological equipment will not stop sales.

AGREEMENT

Samsung pay the sum of US $ 800 million to Apple for unauthorized use of their patents in a period of 6 months starting from today.

Samsung: Silence: No statement regarding Apple.

Apple: conseciones: Possibility to cancel its scheduled debt in installments rather than in one lump sum.

Distributive Negotiation

Samsung: Precipitation: Offer to pay the debt within one month if Apple withdraw allegations that Samsung has imposed on other countries.

Apple: Limits of authority: There is a court order and that Apple can not override it.

Samsung: exaggerated initial offer: $ 100 million

Apple: Drawing the line: No receive less than US $ 800 million

Apple was benefited, but Samsung for a good implementation of negotiation tactics could reduce the amount payable and have a longer period of time for payment. (Cole, 2014)

The agreement does not affect the commercial interests of both companies.

The trials are held in other countries will not be affected by the agreement described.

As this example of negotiation in business suggests, mediation as a dispute resolution technique between business negotiators is far less likely to succeed when the parties are grudging participants than when they are actively engaged in finding a solution. When negotiators feel they have spent significant time and energy in a case, they may feel they have invested too much to quit.

Moreover, the longer they spend fighting each other, the more contentious and uncooperative they are likely to become. The lesson? When a business dispute arises, do your best to negotiate or mediate a solution before taking it to the courts.[1]
